Q. So what's the catch?
A. There isn't one. The lucky winner gains a property prize worth over £300,000 pounds, I get the market value for my home.


Q. Ok so what do I have to do?
A.   Answer the question, enter your details and pay the competition entry fee, then sit back with your fingers crossed!


Q. What are my chances of winning?
A. 35,000 to one. I will only take 35,000 entries before closing the competition. This is much better odds than the lottery - which is 14 million to one!


Q. What if I enter more than once?
A. Then your chances of winning are much better. You can enter as many times as you like.


Q. What does the winner have to pay for?
A. Just the competition entry and the cost of getting here. I will be paying the stamp duty and conveyance costs. All the bills relating to the house will be paid before I leave.


Q. How is the Draw going to take place?
A.  . The winner of the Prize will be the Entrant whose details are randomly drawn before an audience of invited guests, members of the Press and in the presence of a Solicitor. My plan is to do the Draw 1 week after the competition ends 

Q. What happens if I don't reach the 35,000?
A.
If I don't reach the target No of tickets, I will do a cash draw and the winner will receive the total amount of money received instead of winning the property. There are more details on this in the Terms and Conditions.

Q. Why 35,000 tickets?
A. Anyone can work out that 35,000 tickets is a lot. However, after 5% of all ticket sales will go to charity and the legal fees, and Marketing fees, I will be left with roughly the market value of the property

Q. What does it not include?
A. Excluded in the competition is all my personal belongings and furniture,

Q. When would the winner actually take possession of the house?
A. After the draw we will need the winner’s solicitor’s details to process the change of ownership. These timescales are dependent on how quickly the solicitors work.

Terms and Conditions 

Definitions:

COMPETITION: The Competition operated by the Promoter to which these Terms and Conditions Apply, wherein the Entrants submit entries to 16 UPPER BAR,
NEWPORT, SHROPSHIRE, TF10 7EJ  to win the Prize ON THE OFFICAL FORM.

PRIZE: The Freehold of 16 Upper Bar
Newport Shropshire TF10 7EJ.

VALUATION: £300,000 plus stamp duty, and solicitors’ conveyance fees (inclusive of the winner’s solicitors’ fees up to a maximum of £600 + VAT ) (“the Valuation”)

PROMOTER: MIKE BARWELL (“the Promoter”)

QUESTION: The Question which the Entrants must answer correctly (in substantial accordance with the answer held by the Promoter) to obtain an opportunity to win the Prize.

ENTRY: An answer submitted to the Question by the entrant to obtain an opportunity to win the Prize

ENTRANT: Any person (not including a limited company, partnership or limited liability partnership) who enters the Competition  to win the Prize.

WINNER: The Entrant chosen at random on or after the Closing Date who will receive the Prize in accordance with these Terms and Conditions.

MAXIMUM NUMBER OF ENTRIES: 35,000

General

1.       By entering the competition, Entrants are deemed to have read and accepted these Terms and Conditions and agrees to be bound by them;

2.       Upon entering the Competition, all Entrants must submit all contact details requested by the Promoter (which must include a valid e-mail address or contact telephone number) which will be used for the following purposes: (a) to notify the Winner that they have won the prize; (b) to post the Winner's name and town of residence in the paper; and (c) to comply with the Privacy Policy.

3.       All entrants are solely and completely responsible for providing the Promoters with accurate and current contact details.

4.       The Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise.

5.       Privacy policy - The Entrants and the Promoter recognise that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoter to administer the conduct the Competition according to these Terms and Conditions. The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.

6.       The Competition is operated by the Promoter.

7.       The Competition is open for entry to all persons aged 18 or over excluding the Promoter, their family, agents, employees, professional advisers or anyone else connected with the development or operation of the Competition in any way, shape or form;

8.       Entries made by the Entrants to the Competition will only be valid if made on the correct form.

9.       By entering into the Competition, all Entrants acknowledge that their payment of £15.00 (GBP) per entry to answer the Question and thereby enter the Competition does not guarantee in any way that they will win the prize.

10.   The Promoter does not in any way guarantee or makes any representation as to the value of the Prize.

11.   Only completed Entries will be entered into the Competition

12.   As a condition of entering the Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Competition unlawfully;

13.   The Entrants recognise that the Competition is a Prize Competition for the purposes of, inter alia, Section 14 (5) of the Gambling Act 2005 and that to win the Competition via answering the Question depends to a substantial degree on the exercise of the skill, judgment and knowledge of the Entrants and that the Prize is not allocated wholly by chance;

14.   The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoters and Entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration;

15.   By entering the Competition, Entrants warrant that all information which they submit is accurate, true, current and complete. The Promoter reserve the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms and Conditions

16.   There is no limit to the number of entries that any one person can make

17.   The Valuation has and is understood to represent a fair market value for the Property, although due to its uniqueness it is difficult to find a direct comparison in the vicinity of the Property. The Promoter is not responsible or liable in any way for the Valuation and makes no representation or warranty in respect of its accuracy’

18.   All Entries will become the property of the Promoter on receipt and will not be returned.

19.   Entrants will receive a combined confirmation e-mail and receipt from the Promoters within 2 days of receipt of their Entry into the Competition.

20.   The Promoter does not retain details of each Entry for subsequent third party. It is the sole responsibility of each Entrant to retain a copy of the confirmatory e-mail referred to above for their future reference.

21.   The Promoter reserves the right to amend these terms and conditions at any time and for any reason.

The Prize

22.   The purpose of the Competition is to win the Prize; 

23.   The Prize will be transferred by the Promoter to the Winner of the Competition free from all mortgages, charges and other encumbrances at the Promoter’s expense and including all fees, charges and taxes.

24.   The Winner shall ensure that the Prize is registered at HM Land Registry in the Winner’s name;

25.   Payments will only be accepted in pounds sterling.

26.   English is the only language in which an Entrant may submit their entry.

The Competition

28.   The process to determine the Winner will begin the day after the closing date and a final decision will be made within 7 days of that date.

29.   The price of entering the competition is £15.00 (GBP) per entry.

30.   In answering the Question, the Entrant recognises that they must exercise skill and judgement to give the correct Answer’

31.   To conclude an entry into the Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and payment details. Once the Entry is submitted,

32.   Entry to the Competition will only be confirmed upon approval of the payment and by the sending of the combined confirmation e-mail and receipt as described above by the Promoter to the Entrant to confirm their entry into the Competition. The e-mail will confirm the date and time of entry, and the details of the Prize;

33.   When the Maximum Number of Entries or the Closing Date is reached, the Competition will close; however the Promoter reserves the right to extend the closing date by up to 3 months at his discretion.

34.   All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date

35.   The winner of the Prize will be the Entrant whose details are randomly drawn before an audience of invited guests, members of the Press and in the presence of a Solicitor.

36.   The Promoters’ decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described above;

37.   The Winner will be required to forward a copy of their passport or driving licence to the Promoter to prove their identity and that their Entry was made by them.

38.   Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

39.   If the Winner cannot be contacted by the Promoter within 30 days of being notified of their status as the Winner by e-mail, telephone and mail to the contact details submitted in their entry, the Promoter shall be entitled to award the Prize to the Entrant selected by drawing another winning entry at random in the same method as described above (“The Alternate Winner“). The Alternate Winner shall have 7 days from notification of their status by the Promoters to communicate their acceptance of the Prize.

40.   The Winner will be required to sign a transfer deed to transfer the Property into the Winner’s name within 28 days of Transfer of the Property

41.   The Promoter  will donate 5% of the gross ticket price to the Oxfam charity and Newport Cottage Care Centre

Closing the competition

42.   If the sum of 95% of the Maximum Number of Entries to the Competition is not equal to the sum number of entries received as at the closing date, the Competition will close and the proceeds of the Competition will be determined using the formula “number of tickets sold x ticket price” (“the Entry Fees”);

43.   The Winner of the Competition will then be determined in accordance with the method described in clause 35 above;

44.   The Promoter will be entitled to retain up to 35% of the Entry Fees to cover administration and marketing expenditure. The remaining balance following deduction of this sum is “the Prize Fund”. The Prize Fund will then be distributed to the winning Entrant;

45.   The promoter will donate 5% of gross ticket price to charity

  Other Issues

46.   All Entry Fees will be maintained in a Barclays  bank account in the Promoters Name, until the Winner of the Competition has been determined;

47.   All parties recognise that the Promoter will incur Professional Service Fees relating solely to this Competition (Inc Legal, Third Party Marketing Fee’s) via its administration. These Fees may be deducted from the Entry Fees.

48.   The Winner(s) agrees to allow the Promoter to display his or her name in the paper in accordance with the Privacy Policy. The name, age and town of residence of the Winner will be posted in the paper for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined

49.   Entrants authorise the Promoters to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of Privacy Policy

50.   The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoters will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person;

51.   The Promoter makes no representation or warranty as to the Valuation or the Prize, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the Prize before entering the Competition.

52.   Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoter, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize;

53.   The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details.

54.   The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of the Website

55.   The Promoters do not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, or any other reason. It is the responsibility of Entrants to contact the Promoter if you do not receive the combined confirmation E-Mail and receipt as described above within 5 days of the submission of any Entry

56.   These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter.
